We should be aware that the legal responsibility of complying with a planning condition rests with the owner of the piece of land involved at the time the council takes action, and not the original developer. So it is important to ensure that when the developers pass on the ownership of any land- whether to a house owner or a management company- that they first give a legally enforceable undertaking that they will reimburse any costs involved in complying with planning conditions
